Sneak Peek Sweepstakes 2008 Official Rules WIN A Wii System! PLEASE READ THE FOLLOWING RULES AND LEARN HOW TO WIN A Wii Platform System! NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. 1. Eligibility: Open to all legal residents of the United States and the District of Columbia, who are twenty-one (21) years or older by August 5, 2008. Employees of Party City Corporation ("Party City"), prize suppliers, and the immediate families (spouse and parents, siblings and children, and each of their spouses, regardless of where they live) and persons living in the households of each of these individuals, whether related or not, are ineligible. 2. SWEEPSTAKES DATES: Sweepstakes begins August 5, 2008 and ends September 20, 2008 at 12:00pm EST. Winners will be selected by random drawings on or about September 24, 2008 and winners will be notified shortly thereafter. Fulfillment of Grand Prize must occur before October 31, 2008. Selection of the winners will be made solely by Party City or its designee and such selection shall be final. 3. WAYS TO ENTER: Entry is done at www.partycity.com where every visitor to the Sneak Peek will be entered to win. All entries must contain valid email, postal addresses and phone number. Only one entry per person and only one entry per household are permitted. Any entry in violation of these Game rules voids all entries from such person and from such household. You may also enter by mailing a postcard to "Attention: Costume Sneak Peek Sweepstakes", Data Entry, Party City, 804C Greenbrier Circle, Chesapeake, Virginia 23320. All mail entries must be post marked on or before September 13, 2008 and received by September 18, 2008. Party City reserves the right to disqualify any person who attempts to enter more than once. 4. Prizes: Grand Prize: Wii System (prize value $249.99) 2nd Prize: Twenty (20) winners will each receive Goosebumps Horrorland Wii Game (prize value $39.99) 5. Odds: Odds of winning are based solely on the number of eligible entries received. 6. Prize Restrictions: All prizes are non-transferable. No substitution or cash equivalent of the prizes or any portion thereof is permitted except at the sole discretion of Party City. Federal, state, and local taxes and any expenses relating to the acceptance and use of all or any portion of the prizes not specified are the responsibility of the winner. THE GAME IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS. 7. Prize Claims: Each winner will be notified by phone and email and will be required to complete an affidavit confirming eligibility and liability/publicity release ("Release"), which must be returned within five (5) days after prize notification. If both such affidavit and liability/publicity release are not received by Party City from any winner within the five (5) day time period, the prize may be forfeited and an alternate winner selected. If any prize notification or Release is returned as undeliverable, the selected entrant may be disqualified and an alternate entrant will be selected. In the event of a dispute regarding the identity of a person submitting an entry, Party City shall be the sole arbiter of the correct winner and its decision shall be final. 8. Additional terms: By participating, entrants agree to: a) the Official Rules and decisions of Party City which shall be final in all respects;(b) permit Party City to publicly identify the winner on its website, in in-store promotion or other press or public relations media. Additionally, Party City may require the winner to attend a presentation of the prize at a Party City store and the winner agrees to permit Party City to take and release photos of the winners to the media and use the photo on-line at www.partycity.com, (c) release, discharge, and hold harmless Party City, and its officers, directors, employees, attorneys and agents from any liability, claims, or damages arising out of their participation in the Game (including without limitation, any damage to a participant's computer which may arise in connection with internet registration for the Game), and the acceptance, use, misuse, or possession of any prize; and (d) release Party City, its officers, directors, employees, attorneys and agents from any warranty, representation, guarantee whether express or implied, in fact or in law, relative to any prize including but not limited to quality, mechanical condition or fitness therefore. By accepting a prize, the winner agrees to, where legal, Party City and its designees' use of his/her name and/or likeness for advertising and publicity purposes without compensation and, upon request, will provide consent to such use in writing. Party City reserves the right, in its sole discretion, to modify, suspend or terminate the Game should viruses, bugs or other causes beyond the control of Party City compromise the integrity of the administration, security or proper play of the Game. 9. Limitation of Liability: Party City is not responsible for damaged, incomplete, illegible, lost, late, misdirected, postage due entries, or for computer system, hardware, software or program malfunctions or for other errors, failures, or delays in computer transmissions or network connections that are human or technical in nature. Entries become the property of Party City and will not be returned. Web site entries will be deemed to have been submitted by the authorized account holder of the e-mail address submitted on the date the entry was submitted. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. 10.
